v2.4
NSW, Australia
These Valuer Terms and Conditions govern the relationship between Valato Pty Ltd (trading as Valato) and independent valuers who accept assignments through the platform. By accepting an assignment you agree to these terms.
Definitions
“Assignment” means a valuation instruction accepted through the platform; “client” means the party who ordered the valuation; and “you” means the accredited valuer engaged to complete the assignment.
Engagement as an independent valuer
You are engaged as an independent professional, not as an employee or agent of Valato. You retain full professional discretion and responsibility for the opinions expressed in your reports.
Accreditation and compliance
You must hold and maintain current accreditation and act in accordance with applicable professional and regulatory standards.
Current membership of the API, RICS or an equivalent recognised body.
Compliance with ATO requirements for the relevant valuation type, including SISR 8.02B for SMSF work.
Adherence to the International Valuation Standards where applicable.
Accepting assignments
You may accept or decline any assignment offered. Once accepted, you agree to complete the work within the confirmed scope, turnaround and fee, and to notify us promptly if you cannot.
Report standards and turnaround
Reports must be clear, evidence-based and delivered in the agreed format by the confirmed deadline. Each report must document methodology, comparable evidence and the valuation date.
Fees, invoicing and payment
Valato collects the fee from the client and remits your agreed portion after the report is accepted.
Your fee for each assignment is confirmed before you accept it.
Payment is remitted within the agreed cycle following report acceptance.
You are responsible for your own GST and tax obligations.
Professional indemnity insurance
You must hold current professional indemnity insurance to a level appropriate for the assignments you accept, and provide evidence of cover on request.
Confidentiality and data handling
You must keep all client and property information confidential, use it only for the assignment, and handle it in accordance with our Privacy Policy and applicable privacy law.
Conflicts of interest
You must decline any assignment where you have a material interest in the property or a relationship that could compromise your independence, and disclose any potential conflict to us immediately.
Independent contractor status
Nothing in these terms creates an employment, partnership or joint-venture relationship. You are responsible for your own equipment, insurance, superannuation and tax.
Termination and suspension
We may suspend or remove you from the panel for breach of these terms, a lapse in accreditation or insurance, or conduct that risks the integrity of the platform. Either party may end the arrangement on reasonable notice.
